What Is Statutory Holidays?
Definition
From 2025, China's statutory paid holidays total 13 days: New Year 1, Spring Festival 4 (Eve included), Qingming 2 (with swapped days), Labour 2, Dragon Boat 3 (with swapped days), Mid-Autumn 1, National Day 3. "Swapped" weekend days stitched into long breaks are NOT statutory holidays — working them earns no premium; only the statutory days above earn 300% pay. They are a hard right: even with compensatory leave offered, working a statutory holiday still pays 300%.
Formula
Statutory-holiday pay = daily wage × 300%; daily = monthly ÷ 21.75
Worked Example
Monthly 6,525 (daily 300): working all 4 statutory Spring Festival days = 300×3×4 = 3,600 CNY. If 2 of those days are actually swapped Saturdays, they pay 2x or compensatory leave instead.
Common Misconception
Counting the whole 8-day Spring Festival break as 3x days — 4 of them are swapped weekends. And statutory holidays are the only overtime type that compensatory leave can NEVER replace.
